How long do I have to file a personal injury claim in Colorado?
It depends on the type of claim. Most Colorado personal injury claims must be filed within two years. Claims arising from a motor vehicle accident are the major exception, those carry a three-year deadline. Wrongful death and claims against government entities have their own separate, shorter timelines, so it's worth confirming which deadline actually applies to your situation rather than assuming.
What if I was partially at fault for my accident?
Colorado follows a modified comparative negligence rule. If you're found less than 50% at fault, you can still recover damages, reduced by your percentage of fault. If you're found 50% or more at fault, you recover nothing. Insurance adjusters routinely try to inflate an injured person's share of fault specifically because of this rule, so how that percentage gets argued matters a great deal.
Will my case go to trial?
Most personal injury claims settle before trial. That said, I prepare every case as though it might go the distance, because insurers value a claim differently when they know the attorney on the other side is actually willing to try it.
