Cumberlege Law (“Cumberlege Law,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect, how we use it, the circumstances in which we may share it, and the rights you have. It applies to our website www.cumberlegelaw.com,our text-message (SMS) program, and other interactions with our firm.

1. Information We Collect

We collect information you provide directly to us and information generated through your interactions with us, including:

  • Inquiry information: details you submit through a contact or intake form, by email, by phone, or by text regarding a legal matter or request for a consultation.
  • SMS/messaging information: your mobile number, your consent to receive text messages, and the content and metadata of messages you exchange with us.
  • Technical information: IP address, browser type, device information, and usage data collected automatically when you visit our website.

2. How We Use Your Information

We use the information we collect to:

  • Schedule, confirm, and remind you of appointments and consultations;
  • Respond to and follow up on inquiries and intake requests you submit;
  • Provide, maintain, and improve our legal services and our website;
  • Send you administrative or transactional communications, including by text message where you have opted in; and
  • Comply with legal, regulatory, and professional-responsibility obligations.

3. SMS/Text Messaging

If you opt in to our text-message program, we will send you SMS/MMS messages for appointment and consultation reminders and confirmations, and for follow-up on an inquiry or intake request you submitted. Your participation is governed by our SMS Terms & Conditions. You may opt out at any time by replying STOP, and you may reply HELP for assistance. Message frequency varies, and message and data rates may apply.

No Sharing of Mobile Information for Marketing. Cumberlege Law will not sell, rent, lease, or share your mobile telephone number, SMS consent, or opt-in data with any third parties or affiliates for their marketing or promotional purposes. Mobile opt-in information is used solely to operate the text-message program described above and is not shared with third parties for any purpose except as required to deliver the messaging service (for example, our messaging platform provider) or as required by law.

4. How We Share Information

We do not sell your personal information. We share information only in the limited circumstances below:

  • Service providers: vendors who perform services on our behalf, such as our SMS/messaging platform, scheduling tools, email, and IT providers, who are permitted to use the information only to provide services to us. As stated above, mobile opt-in data is never shared with third parties or affiliates for their own marketing.
  • Legal and professional obligations: when required by law, court order, or subpoena, or to comply with our professional and ethical duties.
  • Protection of rights: to protect the rights, property, or safety of Cumberlege Law, our clients, or others, and to enforce our agreements.
  • Business transfers: in connection with a merger, acquisition, or transfer of firm assets, subject to the protections of this Privacy Policy.

5. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with our legal, regulatory, and professional-responsibility obligations, and to resolve disputes and enforce our agreements.

6. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your Colorado Privacy Rights

Under the Colorado Privacy Act, and subject to its exceptions, Colorado residents have the right to:

  • Confirm whether we are processing their personal data and to access that data;
  • Correct inaccuracies in their personal data;
  • Delete personal data we hold about them;
  • Obtain a portable copy of personal data they previously provided; and
  • Opt out of the processing of personal data for targeted advertising, the sale of personal data, or certain profiling.

To exercise these rights, contact us using the details in Section 11. You may appeal a denial of your request by replying to our response or contacting us at the same address. We will not discriminate against you for exercising your rights.

8. Children’s Privacy

Our services are not directed to children under 18, and we do not knowingly collect personal information from children.

9. Third-Party Links

Our website may link to third-party sites. We are not responsible for the privacy practices of those sites, and we encourage you to review their policies.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Changes are effective when posted to this page with an updated Effective Date.
